Thai obligations for businesses abroad.

Does the PDPA apply to companies outside Thailand?
It can. The Personal Data Protection Act B.E. 2562 (2019), fully in force since 1 June 2022, applies to companies outside Thailand that offer goods or services to people in Thailand or monitor their behaviour there (s.5).
Do they need a representative in Thailand?
Such companies must appoint a representative in Thailand in writing (s.37(5)). Exemptions issued by the Personal Data Protection Committee may apply, for example to small-scale processing without sensitive data.
When must a foreign digital service register for VAT?
Since 1 September 2021, foreign providers of electronic services and digital platforms selling to non-VAT-registered customers in Thailand must register through the simplified e-service VAT system once their Thai revenue exceeds THB 1.8 million a year, and remit VAT, currently 7%.
Do digital platforms have to notify anyone?
Under the Royal Decree on Digital Platform Service Businesses Subject to Notification B.E. 2565, in force since 21 August 2023, platforms serving users in Thailand must notify the Electronic Transactions Development Agency (ETDA), and foreign operators must appoint a representative in Thailand. Categories and thresholds are subject to applicable rules and regulations.
Who can hold Thai FDA registrations?
Only a Thai entity with the relevant licence and premises. A foreign brand without a Thai company usually depends on its importer, so changing distributor can mean registering again.
How long does a Thai trademark last?
Registrations last 10 years and are renewable. Thailand is first-to-file, and has been part of the Madrid Protocol since November 2017.

Frequently asked questions

We have no office in Thailand. Do we really need a PDPA representative?

If you offer goods or services to people in Thailand or monitor their behaviour there, the PDPA can apply to you from abroad, and a written appointment of a representative in Thailand is required unless an exemption applies. Our first review tells you which applies.

Can our FDA registrations stay with us if we change distributor?

Not if the distributor holds them: Thai FDA registrations sit with a licensed Thai entity, and changing distributor can mean registering again. Having our licensed partner hold them independently keeps control with your brand.

Can you be the official address for legal documents?

Yes. We provide a registered correspondence and service-of-process address, receive and scan what arrives, and tell you promptly so deadlines are not missed.
